Montana Code Annotated 80-11-516 (5) states "after 30 days and before 90 days following the deduction of the assessment, the seller, may upon the submission of a written, verified request to the department, obtain a refund of the assessment." Please be aware that any requests received after the 90 day deadline will be invalid.

Assessment funds are used to promote and maintain Montana’s high standard of quality crops offered on both national and international markets. Your assessment dollars are pooled with all the producers in the state to fund programs that help you as a Montana producer.

Producers submitting a pulse refund form for the first time will need to submit a completed W9 with their paperwork.

To complete the pulse refund, please submit the refund application for the pulse assessment amount. Please include the elevator slip showing the assessment amount that you wish to refund. Please submit one refund form per purchase company.

All original paperwork will be sent back to you.

At this time all Montana Pulse Crops sold in North Dakota will be refunded by the Montana Department of Agriculture in connection with the Montana Pulse Crop Committee.

80-11-1005. Refund of assessment. (1) A producer who has paid assessments to the department may request that the department refund all or a portion of the assessment levied under the rules of the committee and paid by the producer. A refund request must be submitted in writing on an application form that is available without cost to all producers who pay assessments.

(2) The producer shall complete the refund application and return the application to the department, together with a record of the assessment collected, within 90 days after the date of the assessment or final settlement.

(3) If a refund request is not submitted to the department within the prescribed time period, the producer is presumed to have agreed to the assessment.

(4) A producer is not entitled to a refund under this section unless the refundable amount is $5 or more
