During Montana’s 2021 legislative session, House Bill 396 was signed into law to amend the definition of Commercial Feed to include the use of hemp, or a substance derived from hemp for use in feed for pets, specialty pets, and horses in Montana.
The Montana Department of Agriculture will regulate feed and feed ingredients of hemp and substances derived from hemp for pet, specialty pet, and horses as any other approved animal feed ingredient. Manufacturers and distributors of such feed fall under regulation of Montana’s Commercial Feeds Act and must abide by all laws and rules applied to commercial feed.

Hemp and hemp related ingredients are allowed in:
- Pet food
- Specialty pet food (e.g., turtles, hamsters, ferrets)
- Horse feed
Hemp and hemp related ingredients that are allowed in pet, specialty pet, and horse feed:
- Hemp or substances derived from hemp containing no greater than 0.3% tetrahydrocannabinol (THC)
- Examples include hemp seed, hemp seed meal, hemp seed oil, and more.
Hemp and hemp related ingredients that are NOT allowed in pet, specialty pet, and horse feed:
- Cannabis and substances derived from cannabis with greater than 0.3% THC.
- All CBD products, including CBD oil and industrial hemp seed oil containing CBD.
- Any hemp substance intended for use in the diagnosis, cure, mitigation, treatment or prevention in animals, or a substance other than feed intended to affect the structure or any function of the body of animals.
