What does the Produce Program do for you?

This program provides licenses to produce dealers in order to ensure the quality of fruits and vegetables distributed in Montana. The program's objectives are to:

  • Ensure that produce meets USDA quality standards.
  • Guard against entry of diseases and pests that could harm the fruit & vegetable industry.

How does the program ensure produce quality?

The program provides regulatory services to the public and to specific agricultural industries. To ensure produce quality for Montana consumers, the program inspects and samples produce to confirm that it meets USDA standards and is free from diseases and pests of concern to the fruit & vegetable industry.

Program provides third party inspections for:

  • Produce imported into Montana
    - Grade inspections
    - Condition inspections
  • Produce exported from Montana
    - Grade inspections
    - Shipping point inspections

Seed Potato Inspections

Seed potatoes imported into, exported from or shipped within Montana must meet USDA and state seed grade standards. Seed potatoes must also be free from late blight, bacterial ring rot and potato cyst nematode.

Seed potatoes shipped into Montana are subject to a receiving point inspection. Seed potatoes grown in Montana are subject to a shipping point inspection by the Seed Potato Inspection Program. For more information see: Seed Potato Inspection Program.

Who needs a produce dealer license?

  • Anyone who wholesales produce in Montana;
  • Anyone transporting produce from out of state for retail sale in Montana; and
  • Anyone retailing produce grown in the state when gross retail sales exceed $25,000 annually.

The Produce program inspectors provide third party inpections for:

  • Produce imported into Montana
    - Grade inspections; and
    - Condition inspections.
  • Produce exported from Montana:
    - Grade inspections; and
    - Shipping point inspections

Fees:

The following fees are paid per service, as follows:

  • Minimum fee for any inspection: $50
  • Shipping point inspection fee (for exports): $0.095 per unit of produce shipped
  • Receiving point inspection fee (for imports): hourly fee

A produce dealer license is required for any person who wholesales produce in the state, transports produce from out of state into this state for retail sales, or retails produce grown by the produce dealer in this state when gross retail sales exceed $25,000 annually.

A separate license is required for each place of business, including vehicles.

Licenses are issued annually and are renewed by January 1st of each year.

Produce inspection fees are assessed quarterly from distributors for all produce distributed in Montana.

Fees:

  • Annual Dealer License: $50.00 per place of business, including vehicles
  • Quarterly Assessment: $0.06 per unit distributed
